1. Introduction

The general terms of sale described below (hereunder referred to as “General Terms”), only regulate the contractual relations between all the users of the website www.theblender.be (hereunder referred to as “User” or “You”) and the dealer The Blender belonging to the company Becook N.V, with registered office at 55, Val Fleuri, à L-1526 Luxembourg and registered to the Trade and Compagnies Register under number B 166824; Intra-Community VAT number LU 25762054 (hereunder referred to as “The Blender”).

These general terms of sale are the only terms applicable and replace all other terms, except prior, express and written exceptions. The Blender might occasionally have to change some clauses of these general terms, making it necessary for these terms to be read at each visit to the website TheBlender.be (hereunder referred to as “Website”).

These changes are enforceable as soon as they are put online, and cannot be applied to previously conducted agreements. Each purchase on the Website shall be subject to the applicable general terms on the date of the order. We consider that, by validating your order, after reading them, you accept our general terms without exception. By using the Website, you undertake to respect the General Terms as well as the Terms of use contained herein.

 
2. Placing an order

In order to place an order our website www.TheBlender.be is at your disposal 24/7 (except for maintenance work on the website).

 
3. Product information

The Blender puts, with the greatest care, the information about the essential characteristics of the products online, using amongst other the technical description received from het partners and suppliers and pictures showing the products, and this taking into account the limits of the technology and with respect to the best standards of the market.

 
4. Price

For countries within the European Union, the selling prices shown on the website are mentioned in Euro, all taxes included, but without delivery costs. Possible delivery costs are indicated to the user along the order process and will be added at the end of the order, in addition to the price of the selected products.

The orders to be delivered outside the European Union will be invoiced without taxes. The local taxes, import taxes and custom duties will be paid by the customer to the carrier (Ex : Switzerland, Norway…).

For indication, the Swiss VAT stands at 8% (non-contractual information) of the price excluding taxes. This VAT should be paid to the carrier on top of the import fees that can be charged to the package.

We reserve the right to change our prices, but we commit ourselves to enforce the applicable rates which were mentioned on the Website when you placed your order.  We inform you that when displaying an incorrect price, clearly incorrect (low price), for whatever reason (IT bug, manual error, technical error… ), the order will be cancelled, even after initial validation.

 
5. Availability

Please note we treat your order within the limits of our available stock. Should one of the ordered products not be available in our stock, we undertake to contact you by mail within 15 days after the date of the order to inform you and to give you the period in which the product could be delivered.

If amongst the ordered products, some are temporarily not available, we will propose a product of similar quality and price as a substitute for the product which is not available. Should you refuse, we will refund the relevant product. If you would like to return the product under the conditions stated in article 9 (Right of withdrawal – Refund guarantee), costs will be for our account.

 
6. Delivery

The products purchased on the Website will be shipped to the country of your choice, if the products are certified in these countries.  The Blender does not ship to PO boxes. Your order will be shipped to the address you mentioned when ordering.

If the article is mentioned as “In Stock” at the moment of your order, the period between the order and the first presentation by the carrier, will be determined by the sum of 2 elements:

  • Shipment time (24 to 48 h) = validating your payment + preparing your order + collection of the package or packages by the carrier.Delivery time of your package by the carrier you chose from the options on our website. You will be advised of the start of this period with a mail “Order sent”.

These times are indicated in working days.

The Blender makes every effort to maintain the delivery times as mentioned on the Website. However, we cannot be held responsible for the consequences of delay of the delivery or for the loss of the package by a third party to the contract, by yourself or by an unforeseeable and insurmountable reason of force majeure.   If the package is not received within the mentioned time, an investigation will be initiated with the carrier which can take some days (ex : 15 days with Chronopost). During this period, no refund or resend will occur. At the reception of your order, we advise to check conformity of the delivered products, and, if necessary, indicate all deviations on the delivery note with your signature. Without prejudice to the applicable legal warranty, we advise to send all remarks regarding the conformity of the products at delivery as soon as possible by regular mail to The Blender, Customer Service, 1, Boulevard de la foire L-1428 Luxemburg or by email: serviceclient@becook.lu.

 
7. Secured payment

The Blender is working with payment partners in order to guarantee the safety of your payments.

The Blender provides 4 methods of payment:

Visa

Mastercard

PayPal

When paying by credit card, the money is withdrawn when shipping your order, provided that we received prior approval from the competent payment centres, in default of which your order can not be treated. The online payment per credit card is executed through the secured system “Secure Socket Layer” which codes your bank details when sending them on the net. The name Atos could appear on your bank statement.

We also inform you that The Blender has set up a mechanism to prevent fraud with online payments to protect the consumers.

In this context, The Blender controls the reliability of the information you provide when placing your order.

In case of automatic alarm, caused by the information related to your order, our fraud prevention service can ask you to provide additional information and some documentary evidence (such as: copy of your identity card, proof of address…) on the basis of which The Blender will be able to validate or cancel your order.

In that case, in order to be able to ship your order within the specified period, we advise to provide a phone number where you can easily be reached, and to confirm the information or provide the requested documents as soon as possible.

 
8. Right of withdrawal. Refund guarantee

If you are not completely satisfied with your purchase, you have 14 full days after reception of your order to withdraw. All returns must happen by means of a form, available here; to receive a return number to mention on the package.

9. Return

The product must be returned in original state; so unused; and in the original packaging. The transport and the risks related to this transport, are at the buyer’s expense.

We inform you that the products must be returned to Belgium. The return can be carried out by a carrier of your choice. However, it is recommended to return the goods by registered sending or with tracking and to take insurance with the carrier of the value of the products so that you are covered in case of loss or damage of the products.

At reception of the returned products, we will entirely refund them (delivery costs excluded).

 
10. After sales policy

All our products are covered by the manufacturer’s warranty of minimum 1 year (cfr warranty). In case of a problem with your appliance, we suggest you contact us by means of the corresponding form.

If the problem cannot be solved at a distance, we suggest you send the appliance back to one of our recognised service centres.

If the problem is caused by a correct use of the appliance, the appliance will be repaired and returned without costs.

If the problem is caused by one of the exclusion clauses of the warranty (cfr below), a quote will be made, and the buyer will be able to decide if the appliance should be repaired or not.

 
11. Warranty
a) Warranty period

The warranty periods are mentioned on each product sheet.

The warranty covers, if used as indicated in the user manual,

  • Each default caused by the structure of your appliance
  • All premature damage of the raw materials
  • All defaults of the appliance

This contractual warranty can be obtained providing a proof of warranty (receipt or invoice with date of purchase)

The warranty covers the repair of the appliance, parts and work hours included.

b) Disclaimer of warranty

The Blender cannot be held responsible for the warranty for the exceptions below:

  •  Improper use of the product (cfr user manual)
  • Professional use of the product
  • Intervention by an unrecognized service on the appliance
  • Storage of the appliance in an unsuitable place
  • Alteration of the characteristics of the appliance
  • Falls and shocks the product would have had

The conditions of this warranty are not exclusive of the benefit to the buyer of the legal warranty for defaults and hidden defects.

c) Parts

Conform the article L 111-2 of the Consumer protection law, we provide availability of the parts of a repairable product for a period of 10 years, as from the production date (information on the rating plate). However, this availability is only guaranteed in the country where the appliance was bought.

 
12. Observation, criticism, communication

All observations of the Users of The Blender are checked and moderated by the marketing team. Therefore, if the comments violate the law and the ethic (deceptive advertising, defamatory comments, out of the context comments… ) The Blender reserves the right to refuse or change the corresponding comment.

 
13. Protection of personal data

Since the information you provide is indispensable for the treatment of the order, preparing the invoices and the warranty contracts, the lack of such will lead to cancellation of your order. By registering on the Website, you undertake to provide honest and correct information about yourself. Giving false information is contradictory to these general terms as well as to the conditions of use on the Website. According to the Luxembourg law, your information is treated according the law. All details regarding the treatment of data are available on our website, under ‘Privacy policy.

 
14. Intellectual property

All the content of The Blender Website (pictures, texts, descriptions, brands, images, videos… ) is property of The Blender, its co-contractors or partners. Each reproduction, partial or total, of the content, by any method and on any medium, needs prior and explicit approval of The Blender. All information, content, files and programs offered by our services are protected by the Luxemburg and international law regarding intellectual property and copyright.

The Blender cannot give permission to copy, display or distribute all the content for which you do not have intellectual properties. Each fraudulent use of this content of which the rights belong to a third party is an offense of counterfeiting, severely punished by the Code of the Intellectual Property.  The Blender will not be held responsible under any circumstances for the violation by a user of the rights of a third party and committed as a result of the activities of the user on the Website.
